First of all, without a rebuttable presumption for shared parenting, my ex was and is empowered by what we all know to be extremely gender biased court system. This problem is statutory not judicial. Second of all. The second problem is processes that are woefully inadequate. In Hawaii there has in the history of the family courts never been a case of prosecution against someone who has made outrageous false allegations against a parent. I'm hoping my case be the first. Still awaiting a decision for the court of appeals. I won a favorable decision from the supreme court but it wasn't a complete decision. At the same time there is no test of veracity for allegations and no examination of the totality of the circumstances. Simply submitting paperwork that says I'm get a restraining order put on the alleged offending party. The standard of proof is particularly problematic as it should be as in almost all courts "Clear and Convincing" not "preponderance of the evidence". which is essentially a non-standard. Women are almost never required to pay full support based upon the formula issued by the state. Men almost always are. The adversarial model is a failed model. When the court model take on a collaborative approach to parenting, as some places have implemented. Litigation is reduced substantially and so the consequential issues associated with sole custody parenting drop off drastiy. Buts lets get this straight attorneys have a vested interest in maintaining a highly adversarial system. It's big business and big profits.
